Same-Sex Marriage: A Worldwide Trend?

The first decade of the 21st century saw the legal institution of marriage opened up to same-sex couples in a number of states, beginning with the Netherlands in 2001. This trend was largely influenced by a growth in human rights thinking, particularly in relation to issues such as non-discrimination and equality. This article evaluates the different paths that states have taken to achieve marriage equality and analyses the approaches and factors that influenced law reform in each of these jurisdictions.
