David Cohen, JD (UCLA), PhD (Cantab), is the Ancker Distinguished Professor for the Humanities, Director, Berkeley War Crimes Studies Center, University of California, Berkeley and an Adjunct Senior Fellow in International Law, Visiting Fellow, Hoover Institution, Stanford University.

This chapter examines the political, legal and social context that shaped the creation, operation and function of this tribunal and evaluates its successes and failures, both in achieving justice for the Timorese people, as well as serving as a potential model for the other such tribunals.
