International Trends in Mental Health Laws: Introduction

Bernadette McSherry is an Australian Research Council Federation Fellow and Professor of Law at Monash University.

This article provides an overview of international trends in mental health laws, focusing in particular on the development of the Convention on the Rights of Persons with Disabilities and its combination of civil and political rights on the one hand and economic, social and cultural rights on the other. It outlines some of the themes emerging in the ensuing articles and argues that the stage is set for governments to focus not only on laws relating to involuntary treatment, but also to explore how the law can be used to ensure the right to the highest attainable standard of mental health.
